[Canadian Immigration News] Strengthened Employer Requirements for AAIP

Today, we’d like to share the enhanced employer requirements for the Alberta Advantage Immigration Program (AAIP).

To qualify as an employer under the Alberta AAIP program, the following conditions must be met:

First, the business must be legitimate and provide goods or services.

Second, the job offer must align with the business’s activities.

Third, the employer must fulfill all the conditions based on the employer requirements provided.

So, what are the strengthened employer requirements?

✅ Must be a corporation or business registered in Alberta under Canadian law.

✅ Must have been in continuous and active operation in Alberta for at least 2 complete fiscal years prior to the application.

✅ Evidence of efforts to recruit Canadian citizens or permanent residents is required if employing efforts are made.

✅ Must have a minimum total gross annual revenue of $400,000 for the most recent fiscal year, and employ a minimum of 3 full-time equivalent employees in Alberta.

  • Independent contractors are not considered as employees.
  • Two part-time employees may be considered as one full-time equivalent if the total hours exceed 30 hours per week.

Even if the employer finds it difficult to demonstrate an annual gross income of $400,000 and has employed less than 3 full-time employees, they can still qualify for the program!

However, the number of candidates supported will be limited as follows:

  • If operated in Alberta for 2 years, only 1 nominee is supported.
  • If operated in Alberta for 3 years, only 2 nominees are supported.
  • For each additional year of operation, 1 additional nominee can be supported.
  • Indigenous, municipal, provincial, and federal government employers do not need to meet revenue and minimum employee requirements.
  • Caps on number of nominees an employer can support will be applied to applications received on or after March 18, 2024. Note, if a nominee leaves the employer, the nomination will continue to be counted towards job offer eligibility/employer operations.
  • You must confirm with your employer that they are able to support your application. Your application fee will not be refunded if your employer supports more applicants than permitted based on their years of operation in Alberta.
